Your use of Explore India subject to the following Terms of Use (TOU). VedSur Marketing Services Private Limited (VedSur) shall have the sole authority to update this TOU at any time without giving prior notice to you. The most current TOU shall be available on the application server for your reference.
Explore India Location Intelligence application is the 'Software and Data As Service (SDAS)' platform. It is created using a multitude of databases following internationally accepted concepts, standards and norms. The database represents the Indian population. The base for population estimates is the Census of India, made available from time to time. The functionality of the application as well as the database would be continuously updated and enhanced to make it more useful for the subscribers.
Explore India has finite number of variables for area profile. These variables may not be entirely suitable for the intended purpose. Further, the database may not be always updated to the current population estimates. It is important to note that certain assumptions and hypotheses were imperative to be made, in order to arrive at the overall database as well as to arrive at area estimates. All the information areas included in this tool are purported to benefit the users of such syndicated product, for making informed decisions.
You may not copy, distribute, transmit, display, reproduce, modify, publish, license, create derivative works from, transfer, or sell whole or any portion of the Explore India without the prior written approval of VedSur Marketing Services Pvt. Ltd. in any medium including digital or print. The whole and all portions of the Explore India are the copyrighted work of VedSur. Use of the Explore India is governed by this TOU agreed upon between VedSur and the subscriber. Without limiting the foregoing, copying or reproduction of the Explore India in whichever manner and form for further reproduction, redistribution or for developing derivatives thereof is expressly prohibited, unless such reproduction or redistribution is expressly permitted by VedSur.
VedSur makes no representations about the suitability of the methods or the information contained in the Explore India for any purpose. The Explore India or any portion thereof is hereby provided 'as is' without warranty or undertaking of any kind. VedSur disclaim all liabilities arising out of the use of the information, directly or indirectly as contained in Express India. VedSur disclaim any warranties and conditions and undertakings with regard to the Express India including any information, form, content and the suitability of the contents for any purpose and the veracity of the Explore India. VedSur shall not be liable for any special, indirect or consequential damages or any damages whatsoever resulting from the use, direct or indirect of Explore India, whether in an action of contract, negligence or other tortuous action, arising out of or in connection with the use of information available as part of Explore India. Users of Explore India, its tools and database, expressly understand and agree that VedSur shall not be liable for any incidental, special, consequential or exemplary damages, including but not limited to, damages or loss of profits, goodwill, use, data or other intangible losses resulting from the use or inability to use the data, services interpretation or inability to do so any other matter relating to this data or service.
As a condition of your use of Explore India, you will not use it for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use Explore India in any manner that could damage, disable or impair VedSur. You may not attempt to gain unauthorized access to the contents of Explore India.
Explore India is a subscription service. VedSur grants your organization (the registered entity with Registrar of Companies, in case of Indian organizations) a non-transferable and non-exclusive right and license to use Explore India application and data only for the period of subscription, only for the business interests of your organization or for business prospecting; provided that you or any member of your organization do not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the software or the data thereof. You agree not to modify the software in any manner or form, or to use modified versions of the software, including (without limitation) for the purpose of obtaining unauthorized access to the database. You agree not to share Explore India software login credentials with anyone except for the registered user. No part of Explore India may be reproduced or used in any form or by any means graphic, electronic, or mechanical including photocopying, recording, taping, or information storage or retrieval systems without the prior written consent of, and acknowledgement of credit to, 'VedSur Marketing Services Pvt. Ltd. (VedSur)'. Explore India is confidential to the subscriber.
All disputes are subject to the exclusive jurisdiction of the courts of Mumbai.
